Blade Runner: the urgency of European-funded projects in light of recent legislative changes

The need to meet strict deadlines for the utilisation of European funds, particularly under the Recovery and Resilience Plan (PRR), has led to the adoption of a set of legislative measures aimed at streamlining the formation and execution of public contracts. These include provisions introducing changes to the special public procurement measures (Law No. 43/2024 of 2 December) and those establishing a regime that waives the requirement for reviewing the execution project (Decree-Law No. 108/2024 of 18 December).
Mastering the practical issues that may arise when applying these regimes is essential for a more professional approach to managing projects financed by European funds, involving all stakeholders engaged in public procurement activities.
Through this training programme by SÉRVULO INNOVATION LAB, we aim to foster an informal and collaborative environment to analyse and discuss the risks associated with the application of these legal frameworks, adopting a pragmatic approach focused on resolving issues identified through practical experience.

Changes in the role of the Court of Auditors (special prior scrutiny) and streamlining of pre-contractual procedures (waiver of prior review of the execution project in public works contracts).
Judicial remedy (the exceptional regime in pre-contractual litigation).
Risks:
a) In relation to funding (the risk of losing European funds).
b) Concerning the public manager (from financial liability to responsibility for reimbursing European funds).
Conclusions

Equip participants with the essential knowledge required for the correct application of the new regimes governing contracts financed by European funds, adopting a primarily practical approach focused on analysing and discussing the key issues raised by these new frameworks.
